Crpc की धारा 173 में चार्जशीट की के बारे में उल्लेख किया गया है। जिसमें बताया गया है कि पुलिस द्वारा किसी केस की जांच की अंतिम रिपोर्ट Crpc की धारा 173(2) के अन्तर्गत चार्जशीट कहलाती है। चार्जशीट को किसी आरोपी के खिलाफ 60 से 90 दिनों के अंदर जांच अधिकारी द्वारा कोर्ट के समक्ष पेश किया जाता है। अगर पुलिस द्वारा चार्जशीट कोर्ट में नही पेश की जाती है तो गिरफ्तारी को अवैध माना जाता है और आरोपी जमानत पाने का हकदार बन जाता है। के .वीरास्वामी बनाम भारत सरकार और अन्य के मामले में सुप्रीम कोर्ट ने कहा था कि CrPC की धारा 173(2) के तहत चार्जशीट अतिम रिपोर्ट है। Section 173 of CrPC mentions about charge sheet.
