भारतीय दंड संहिता की धारा 19 के अनुसार कौन व्यक्ति न्यायाधीश हो सकता है?Who can be a judge as per section 19 of the Indian Penal Code?r
न्यायाधीश:- न्यायाधीश शब्द न केवल हर ऐसे व्यक्ति का द्योतक है जो पद के रूप में न्यायाधीश अभिहित हो किंतु उस हर व्यक्ति का भी द्योतक है -
या
दूसरे शब्दों में भारतीय दंड संहिता की धारा 19 के अनुसार न्यायाधीश शब्द ना केवल हर ऐसे व्यक्ति का द्योतक है जो पद से न्यायाधीश अभिहित हो किंतु उस हर व्यक्ति का भी द्योतक है -
जो किसी विधि कार्यवाही में चाहे वह सिविल हो या दांडिक अंतिम निर्णय ऐसा निर्णय जो उसके विरुद्ध अपील होने पर अंतिम हो जाए या ऐसा निर्णय जो अन्य प्राधिकारी द्वारा पुष्ट किए जाने पर अंतिम हो जाए देने के लिये विधि द्वारा सशक्त किया गया हो अथवा जो उस व्यक्ति निकाय में से एक हो जो व्यक्ति निकाय ऐसा निर्णय लेने के लिए विधि द्वारा सशक्त किया गया हो ।
( i ) सन् 1859 के अधिनियम 10 के अधीन किसी वाद की अधिकारिता का प्रयोग करने वाला कलेक्टर ( collector ) न्यायाधीश है ।
( ii ) किसी आरोप के संबंध में जिसके लिए उसे जुर्माना या कारावास देने की शक्ति प्राप्त हो , चाहे उसकी अपील होती हो या ना होती हो अधिकारिता का प्रयोग करने वाला मजिस्ट्रेट न्यायाधीश है ।
( ii ) मद्रास संहिता के सन् 1816 के विनियम 7 के अधीन वादों का विचरण करने को और आवधारणा करने की शक्ति रखने वाली पंचायत का सदस्य न्यायाधीश है ।
( iv ) किसी आरोप के सम्बन्ध में , जिसके लिए केवल अन्य न्यायालय को विचारार्थ सुपुर्द करने की शक्ति प्राप्त है , अधिकारिता का प्रयोग करने वाला मजिस्ट्रेट न्यायाधीश नहीं है ।
धारा 19 के दृष्टांत( ख) के अनुसार किसी आरोप के संबंध में जिसके लिए उसे जुर्माना या कारावास का दंड देने की शक्ति प्राप्त है चाहे उसकी अपील होती हो या ना होती व अधिकारिता का प्रयोग करने वाला मजिस्ट्रेट न्यायाधीश है।
धारा 19 के दृष्टांत (घ) के अनुसार किसी आरोप के संबंध में जिनके लिए उसे केवल अन्य न्यायालय को विचारणार्थ सुपुर्द करने की शक्ति प्राप्त है अधिकारिता का प्रयोग करने वाला मजिस्ट्रेट न्यायाधीश नहीं है।
इस प्रकार इस धारा के अन्तर्गत उच्चतम न्यायालय उच्च न्यायालय के न्यायाधीश , जिला न्यायाधीश , सहायक न्यायाधीश और अधीनस्थ न्यायाधीश आते हैं । परन्तु संघ बोर्ड का सभापति न्यायाधीश नहीं है क्योंकि उसे विधि कार्यवाही में विधि द्वारा अन्तिम निर्णय देने के लिए सशक्त नहीं किया गया है ।

In other words, according to section 19 of the Indian Penal Code, the word judge not only denotes every person designated as a judge, but also every person who -
Whoever is empowered by law to give final judgment in any legal proceeding, whether civil or criminal, a judgment which shall be final on appeal against him or a judgment which shall be final if it is confirmed by any other authority, or which Be one of a body of persons empowered by law to take such decision.
(i) The collector exercising jurisdiction over a suit under Act 10 of 1859 is a judge.
(ii) A Magistrate exercising jurisdiction in respect of a charge for which he has power to award fine or imprisonment, whether an appeal or not, is a Judge.
(ii) a member of a panchayat with power to try and adjudicate suits under regulation 7 of the Madras Code of 1816, is a judge.
(iv) in respect of a charge which has power to commit for trial to another Court only, the Magistrate exercising jurisdiction is not a Judge.
According to illustration (b) of section 19, in respect of a charge for which he has power to punish with fine or imprisonment whether there is an appeal or not, and the Magistrate exercising jurisdiction is a Judge.
A Magistrate exercising jurisdiction in respect of any charge which he has power to commit for trial to another Court only is not a Judge in accordance with illustration (d) of section 19.
Thus, under this section, judges of the Supreme Court, High Court, district judges, assistant judges and subordinate judges come. But the Chairman of the Union Board is not a judge as he is not empowered by law to give final decision in legal proceedings.
